One idea would be to adopt the “loser pays” system used in the United Kingdom and most of Europe to deter frivolous lawsuits. For example, in England last fall, a patient, who sued his doctor for $350 claiming the doctor had given him a cold during an examination, was ordered to pay almost $1,500 in costs after his case was thrown out of court.
