Emne: Cheshire Cat Chess - checkmate??

I am trying to play this crazy variant. I was looking at some archived games, and came across this one: Cheshire Cat Chess (bobowski74 vs. kleineme)

Can anyone explain to me why Black is checkmated? There appear to be two legal moves to escape from check: 9... Ka5 or 9... Kb4

Maybe there is something missing from the description of the Cheshire Cat Chess rules?

RGroszkiewicz: It's because the white king hasn't moved yet. First time the king moves, it can move like a queen, so it's actually covering those two squares. It should be in the rules somewhere.
