EIHN: Well lots of songwriters do give permission for their songs lyrics to be publish, if you are deaf you need the lyrics. And you can find these lyrics on the web.
EIHN: I believe the rule about not posting lyrics on this site was discussed awhile back, but was just today added to the description of the board - even though the rule has been around for awhile. And lyrics posted on the web may or may not be in the public domain. Sometimes they are posted there without the artist permision and not in public domain. It's beter safe then sorry to not post anything rather then try to figure out if every post of lyrics are valid or not.
Plus it takes up a lot of room on the board, and I believe Fencer said he did not want the room to scroll with song lyrics - or something like that.
EIHN: I emailed the Library of Congress to verify this once....look back through the posts of this discussion board and you will see the answer to your question.

I only personally know lyrics to a couple hundred songs...theres o way I could tell if any lyrics posted were original....so no lyrics period.I'm sorry,but thats the rules.
EIHN: They would be entitled to post them.. unless they had something written in a contract with another publisher.. but, usually that only concerns when there is money involved.. anotherwards, if the author of the lyrics or poem were making money off of the first publisher and the contract stated they were not allowed to sell their lyric or poem to anyone else during the contract time..
So to sum it all up.. Since no money is exchanged here on this site you as the author would be permitted to post the lyric/poem without breaking a contract.. as long as you were the author of said writing..

If they are your lyrics, yes. If the lyrics belong to someone else, then, generally, no. The right to distribute copies of a work vest with the owner of rights in the work - it is an exclusive right granted under the law. Posting the lyrics on a website without permission would generally be an infringement, unless it falls under the concept of Fair Use ( see: http://www.copyright.gov/fls/fl102.html).

As it was before...if there is a song you wish to discuss...you can post part of the song.And as I just said prior to EIHN posting her song...no lyrics period,because I dont know for sure their your lyrics.
bwildman: I don't see why you can't allow people to post lyrics that they claim to own the copyright of. Afterall, how do you know that the prose making up people's messages isn't copyrighted? Surely, if a poster asserts that he/she is the copyright holder of posted material, and BrainKing.com had no evidence otherwise, then said material should be allowed. Should there later be a dispute regarding the material's copyright, the poster, and not BrainKing.com, would (1) face the burden of proof that he/she was indeed the copyright holder, and (2) be responsible for any violations of copyright arising from the posting of said material. No?
